DMCA Policy
Avis Les Rayons ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Avis Les Rayons service and/or website (the "Service") if such claims are reported to our Designated Copyright Agent identified below.
This policy describes the information that should be present in a DMCA notice and counter-notice. We recommend consulting with a legal advisor before filing a notice or counter-notice to ensure compliance with the DMCA and other applicable laws.
Filing a DMCA Notice of Alleged Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please submit a written notice ("DMCA Notice") to our Designated Copyright Agent with the following information (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work itself.
- Identification of the material that you claim is infringing and where it is located on the Avis Les Rayons Service, including, at a minimum, the URL(s) of the web pages where the allegedly infringing material is displayed, and if possible, the specific content within those pages (e.g., image, text, video).
- Your name, address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your DMCA Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
You can send your DMCA Notice to our Designated Copyright Agent via our Contact Us page.
Filing a DMCA Counter-Notification
If you believe that the material you posted on the Service was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements). The counter-notification must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Avis Les Rayons may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
You can send your DMCA Counter-Notification to our Designated Copyright Agent via our Contact Us page.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
